Any time you want to define a relationship with someone you are creating an Agreement. Sometimes it is informal - it might be oral; and other times it's more formal, and written down. In either case, what's important is that both sides are clear on what the "terms of the deal are".
What really matters is what happens when you no longer agree about who's responsible for what. An oral Agreement is binding, but the terms are harder to pin down. What changes did both sides agree to? In a written Agreement you may have mistakenly thought it wasn't important to document the changes that you agreed to.

An attorney can offer two different types of services:
The first is the most common -- You come in, we talk about the deal points, and I help you develop the terms of the Agreement. I talk to the attorney on the other side. We all come to terms that both sides are satisfied with, and a final Agreement is prepared for signatures.
The second type of service -- both sides know what they want in a contract. In that case both sides can come in talk to me. I act as your scribe. I formalize the terms you have agreed on. I bring to your attention some items that need to be included, and I draft an Agreement for the parties to sign.
